Divorce: We handle all aspects of a divorce, from the "Divorce Planning" stage (when one is considering, but not committed to obtaining a divorce) to the completion of your case, and even the enforcement or modification of the existing orders.  This process includes issues of child custody and parenting plans, with the focus on the children, if any.  We also resolve issues of child support, spousal support, and property division.  With your bottom line in mind at all times, we look to provide a low-cost divorce with the best results for you and your family.

Child Support: Whenever parents are separating (whether married or cohabiting), the issue of child support is important.  It is both parents’ responsibility to provide for the children of the marriage.  The amount of the child support payment is based on many factors, including income, custodial time share, additional costs of the children such as daycare, and your expenses, such as a mortgage.  Before you agree on a set sum of child support, please be sure that you speak with an attorney as there may be serious consequences to the entry of a court order for child support, such as the possibility of being convicted of contempt of court for failing to pay your court-ordered child support.  Alternatively, you may accept a child support amount far lower than a court would order based on California’s child support guidelines. 

Property Division: The time of a divorce or legal separation is also a time of property division.  It is important that you be aware of your rights with respect to real property, retirement accounts, vehicles, stock options, and any property that you may have had prior to your marriage.  Additionally, many individuals often find that at time of a divorce or legal separation, property starts to “disappear” or its existence is denied.  We aggressively work to trace all hidden assets in order to maximize our clients’ recovery.

Mediation: We strongly believe in the ability to mediate a case.  This will save the client both money and heartache.  While every case cannot be resolved through mediation, every effort should be made to settle, if at all possible.  In fact, this process is so respected in Los Angeles County, that the Court will often issue attorney fee awards as sanctions to the party who did not accept a reasonable settlement offer.

Modification: Once orders are placed in effect, they are modifiable based on many factors, including the stage of the case (pre-judgment or post-judgment) and conditions, such as a change in circumstance.  It costs you nothing to take advantage of our free consultation to see if it is worth to attempt to modify a court order.

Paternity: A paternity case involves determining parentage, custodial rights, child support obligations, and possible attorney’s fees.  We aggressively work to be sure that your rights are protected in these areas.

Attorney Fee Awards: California attempts to “level the playing field” so that neither party has an unfair advantage toward the other.  At all times, we attempt to minimize your attorney fee expenditures, but even with low cost attorney’s fees, it is often important to receive a contribution from the other party.  We attempt at all times to seek a contribution, when appropriate.

Child Custody: The reality is that there is no “typical” child custody or visitation schedule.  As is often the case, with a two-parent working household, the parenting responsibilities have often been split between both parents.  As a result, it is possible for both parents to exercise a large amount of custodial time with the children upon a separation.  However, at all times, the best interests of the minor child(ren) should be protected.  We are committed to putting your family first and finding the best resolution for your children.  As a court-appointed Minor’s Counsel, Beatriz Pelayo-Garcia has had the benefit of the seeing custodial disputes from the viewpoint of children in a divorce and focuses on ensuring that children are left out of a custodial dispute, as it is an adult matter.
